Single Lawyer Solution
Divorce and separation can easily become hostile, stressful, and expensive. Traditionally, each person hires their own lawyer and the process often turns adversarial. Over the years, family law has explored alternatives such as mediation and collaborative law—aimed at reducing conflict and costs.
Now, a new option is emerging: the single lawyer solution.
No, it’s not a dating app for lonely legal professionals. Instead, it’s a practical approach where one lawyer works with both parties to resolve matters fairly and efficiently.
This model is already common in some European countries like Italy and Sweden. Since 2020, it has also been recognised here in England, provided that key safeguards are met.
How it Works
One lawyer, two clients: Both parties receive advice from the same lawyer, who acts neutrally and explains likely court outcomes, practical options, and settlement proposals.
Not mediation, not litigation: Unlike mediation, the lawyer provides legal advice. Unlike traditional litigation, the lawyer is not partisan.
Support from experts: In some cases, additional input from financial advisers or barristers may be needed—covering mortgages, tax, investments, or settlement testing.
This approach works best where there is trust, openness, and no evidence of pressure, abuse, or coercion.
Benefits
Reduced cost compared to hiring two lawyers
Faster and less adversarial process
Clarity from the outset, rather than after disputes have escalated
A focus on practical, fair solutions rather than “taking sides”
Frequently Asked Questions
Who pays for the lawyer?
You can split the cost equally, or agree on another arrangement. Fees can usually be fixed in advance to avoid surprises.
What if we can’t agree?
If negotiations break down, the single lawyer cannot continue to act for one party. You would each need to instruct your own lawyers. Discussions with the single lawyer are “without prejudice” and cannot be used later in court.
Can I still get independent advice?
Yes, you can seek a second opinion, though doing so may reduce the benefit of the single lawyer approach.
How do we choose a barrister or financial adviser if needed?
Your lawyer can recommend trusted professionals tailored to your situation.
Do we need a court order once we agree?
For finances: Yes. A court order is required to make agreements binding (e.g. pension sharing). The single lawyer can draft this for you once you reach the conditional order stage of divorce.
For children: Usually no. The “no order” principle applies unless there’s a reason to involve the court. Still, it’s wise to put agreed arrangements in writing—covering term-time, holidays, and handovers.
