Navigating Divorce with Confidence

Divorce or dissolution of a civil partnership can feel overwhelming, even when the legal process itself is relatively straightforward. At Laws Bureau, our family lawyers are here to guide you through every step with clarity, compassion, and practical advice.

The Divorce Process in England & Wales

  • Divorce and civil partnership dissolution are now based on a no-fault system – meaning neither party has to prove blame.

  • Applications are made online through the government portal.

  • Either one or both partners can apply, stating that the marriage or partnership has broken down irretrievably.

  • Once the application is accepted:

    • A 20-week cooling-off period begins.

    • After this, you can apply for a Conditional Order (formerly Decree Nisi).

    • 6 weeks and 1 day later, you can apply for the Final Order (formerly Decree Absolute), which legally ends the marriage or partnership.

Costs

  • Court fee: £593

  • Our fees: £500–£750 plus VAT, depending on the level of support you need.

Judicial Separation

If you’re not ready to divorce but want a formal legal separation, you may apply for a Judicial Separation.

  • Court fee: £365

  • Our fees: Similar to divorce fees.
    This does not legally end your marriage, but it does allow the court to make orders regarding finances, property, and other important arrangements.

Frequently Asked Questions

Do I need to get divorced?

Not necessarily. However, remaining legally married can have financial consequences if claims are not resolved or formalised in a court-approved settlement.

What happens if I don’t divorce?

You can live separately without divorcing, but:

  • You cannot finalise a binding financial settlement without divorce or judicial separation.

  • A separation agreement can record arrangements but is not legally enforceable.

  • You should update your Will, death-in-service benefits, and property ownership to reflect your wishes.

What are the timescales and costs?

  • DIY divorce: Court fee only (£593).

  • With a lawyer: Usually £500–£1,000 plus VAT depending on support required.

  • Timescale: Around 7–10 months under the no-fault system, due to built-in cooling-off periods.

Can the other party stop me divorcing them?

No. Under the new no-fault divorce law, cases cannot be defended. While difficulties can arise, the process cannot be blocked.

What do I need to start a divorce?

  • Court fee payment.

  • Completed online forms.

  • Original marriage certificate (or certified copy).

  • If the certificate is not in English or Welsh, a formal translation is required.

Will I have to go to court?
